Terms of Service

1. Acceptance of Terms

By accessing or using the Fahari Loan management platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Fahari Loan is a loan management platform designed to help financial institutions and individual lenders manage their lending operations, including borrower management, loan application processing, repayment tracking, and financial reporting. Fahari Loan is a software tool only — it is not a lender and does not provide, broker, or guarantee loans or financial services.

The Service is owned and operated by Sonismarts Digital Agency, a registered data collector and data processor with the Personal Data Protection Commission (PDPC) of Tanzania under Certificate Number 0-000-010-752, in accordance with the Personal Data Protection Act, 2022.

3. User Accounts

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You must immediately notify us of any unauthorized use of your account.
• You are responsible for all activities that occur under your account.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Attempt to gain unauthorized access to any part of the Service.
• Interfere with or disrupt the Service or servers connected to it.
• Upload false, misleading, or fraudulent financial data.
• Use the Service to facilitate money laundering or other financial crimes.

5. Data Accuracy

You are solely responsible for the accuracy of data entered into the Service, including borrower information, loan amounts, interest rates, and repayment records. Fahari Loan is not liable for decisions made based on inaccurate data entered by users.

6. Financial Disclaimer

The Service is a management tool and does not constitute financial advice. All lending decisions, interest rates, and loan terms are the sole responsibility of the user. Fahari Loan does not guarantee the accuracy of any financial calculations.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Fahari Loan shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, goodwill, or other intangible losses resulting from your use of the Service.

8. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease.

9. Changes to Terms

We may modify these Terms at any time. We will notify you of changes by updating the “Last updated” date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the United Republic of Tanzania. Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Tanzania.
